National Security Technology Joint Stock Company (Công ty Cổ phần Công nghệ An ninh Quốc gia; hereinafter referred to as “NST”) respectfully informs its valued Customers of the Terms of Use applicable to Customers using the goods, services and solutions provided by NST (hereinafter collectively referred to as the “Products”). These Terms of Use of NST comprise the provisions below and the policies, terms/notices provided by NST to the Customer in writing or by electronic means. By accessing the NST Platform, providing information to NST and/or using the Products, the Customer hereby agrees and confirms that it has carefully read, understood and agreed to, and is bound by, the entire content of these Terms of Use.
1. INTERPRETATION
1.1. NST: is the abbreviation of NATIONAL SECURITY TECHNOLOGY JOINT STOCK COMPANY (Công ty Cổ phần Công nghệ An ninh Quốc gia; Enterprise Code: 0111279276), including the head office, offices, branches and business locations (No. 5 Nguyễn Thị Duệ Street, Yên Hòa Ward, Hà Nội City, Vietnam) of NST.
1.2. Terms: means these Terms of Use and their amendments and supplements from time to time.
1.3. NST Platform: means the website(s), systems and/or software owned, managed and operated by NST for the purpose of providing the Products to the Customer.
1.4. Customer: means any individual or organisation that approaches, learns about, accesses or registers to use the Products and/or the NST Platform.
1.5. Products: include the goods, services and solutions provided by NST.
1.6. Contract: means the contract for the provision of the Products between NST and the Customer.
1.7. NST Partners: means individuals and organisations cooperating with NST to support, advise or provide products and services to NST in the course of NST providing the Products to the Customer, products and services related to the Customer’s needs, or products and services under contracts or agreements with the Customer.
2. NST’S PRODUCTS
2.1. NST provides technology Products including but not limited to:
AI camera devices;
Facial recognition software;
Data management, analysis and storage systems;
Integration platforms and APIs.

2.2. NST has full discretion to decide on the operation, provision, modification, upgrading, development or adjustment of the Products in accordance with NST’s policies and regulations so as to suit NST’s actual operations and applicable laws.
3. CONDITIONS FOR USING THE PRODUCTS
3.1. The Customer warrants that it has full capacity for civil acts in accordance with applicable laws and, where acting on behalf of an organisation or enterprise, the Customer undertakes that it has full lawful authority of representation to bind such organisation or enterprise to these Terms. Accessing the NST Platform or using the Products signifies that the Customer confirms that it has read, understood and agreed to comply with the entire Terms of Use and the related policies published by NST from time to time.
3.2. The Customer undertakes to use the Products for lawful purposes, consistently with the technical functions of the devices and systems, and in full compliance with applicable laws, including but not limited to regulations on cybersecurity, personal data protection and intellectual property. The Customer shall not use the Products for the purpose of unauthorised surveillance, unlawful data collection, infringing the rights or lawful interests of other organisations or individuals, or carrying out any act that may cause damage to NST or third parties.
3.3. The Customer is not permitted to: (i) gain unauthorised access to NST’s systems, servers or data; (ii) interfere with, sabotage, disrupt or affect the normal operation of the Products; (iii) distribute malicious code, malware or any tool capable of compromising information security; (iv) analyse, decompile, disassemble or attempt to extract the source code, algorithms or security mechanisms of the Products; (v) use automated programs, technical tools or technical methods to exploit the systems without authorisation; or (vi) carry out cybersecurity testing, scanning or assessments without NST’s prior written approval.
3.4. NST has the right to refuse to provide, suspend or terminate the provision of the Products to the Customer where NST has reasonable grounds to believe that the Customer has breached these Terms, used the Products unlawfully, caused cybersecurity risks or engaged in conduct affecting the lawful rights and interests of NST or third parties.
3.5. When activating and using an AI Camera device for the first time, the Customer is responsible for changing, and must change, the device’s default password to a unique password of high complexity as instructed by the system in order to proactively prevent brute-force attacks over the network.
4. PROCESSING AND PROTECTION OF PERSONAL DATA
NST and the Customer shall ensure compliance with the terms and conditions on the processing and protection of personal data set out in the Privacy and Personal Data Protection Policy.
5. PRODUCT COMMITMENTS AND LIMITATION OF NST’S LIABILITY
5.1. The Customer understands that the Products are provided with NST’s highest professionalism and on an “as is” basis, in accordance with the existing features and specifications of the Products and the NST Platform. NST makes no representation or warranty of any kind, whether express or implied, in relation to the Products and the NST Platform.
5.2. NST applies reasonable measures to protect the systems commensurate with the type of Products provided to the Customer, including:
- Access control;
- Data encryption;
- System activity monitoring.
5.3. NST endeavours to keep the Products operating in a stable, continuous and secure manner. However, NST does not guarantee and shall not be liable for any interruption, delay, malfunction, loss or destruction of data, or other errors of the Products and the NST Platform arising from viruses, third-party software, the Customer’s fault or other force majeure risks. The Customer agrees that NST shall in all cases be exempt from liability for matters relating to the above-mentioned incidents.
5.4. NST’s AI camera hardware and firmware are designed in compliance with the basic cybersecurity technical regulations under QCVN 11:2026/BCA; the system proactively disables unused logical interfaces, strictly validates all input data streams and is capable of automatically restoring a secure configuration state after an interruption of the power supply or network connection.
5.5. NST undertakes to publicly release, and to maintain the provision of, software updates and cybersecurity patches for each type of AI Camera device distributed by NST for a minimum period of three (03) years from the date on which that product line ceases commercial production.
5.6. NST shall be exempt from all liability to the Customer and third parties in the following cases:
NST shall bear no legal liability whatsoever for the Customer’s use of the Products, including but not limited to (i) the information with which the Customer registers to use the Products; (ii) the content, images and data that the Customer collects and processes through the Products.
The Customer loses, has stolen, discloses or suffers the disclosure of its access information, or fails to comply with any of the terms and conditions of these Terms and the Contract, resulting in another party using the Products or the NST Platform and gaining access to the Customer’s data and information.
The provision of the Products is interrupted, postponed, delayed or unavailable in the event of: (i) internet network errors; or (ii) malfunctions of or incidents affecting NST’s technical systems, transmission errors of telecommunications networks, or interruptions caused by third parties beyond NST’s control; or (iii) hardware and/or software errors beyond NST’s control; or (iv) problems arising from the Customer’s technical systems;
Cases in which NST is entitled to suspend or terminate the provision of the Products to the Customer, including:
The Customer breaches the provisions of these Terms, the Contract or the law;
Requests from competent authorities;
The emergence of serious security risks;
Other cases as provided for in these Terms, the Contract and the law.
All losses, disputes, lawsuits, complaints and other legal liabilities arising that are determined to be due to the fault of the Customer and/or the Customer’s representatives or authorised persons;
In no event shall NST be liable to the Customer or to any other third party, whether under an agreement or by any other means, for damages that are indirect, incidental or have no causal relationship with NST’s acts, including but not limited to (i) economic damage and loss of revenue or profit of the Customer; (ii) the relationship between the Customer and relevant third parties; and (iii) losses or liabilities caused by other causes beyond NST’s control or by force majeure events.
5.7. The Parties understand and agree that any penalties and/or compensation for damages payable by NST to the Customer (if any) shall in no event exceed the value of the Product usage fees paid by the Customer to NST in the most recent 12 months.
6. RIGHTS AND OBLIGATIONS OF THE PARTIES
The Parties shall exercise their rights and perform their obligations in accordance with these Terms, the Contract and the law.
7. INTELLECTUAL PROPERTY RIGHTS
7.1. All intellectual property rights relating to the Products, including but not limited to software, technical documentation, algorithms, programs, source code, images and logos (“NST Intellectual Property Assets”), are and shall always remain assets under the intellectual property ownership of NST, regardless of whether such intellectual property rights have been registered with the competent authorities. Nothing in these Terms permits the assignment or transfer of ownership of the NST Intellectual Property Assets to the Customer or to any other third party. The Customer shall not use, edit, publish, imitate, translate, create derivative works from, distribute, or in any form use, reuse, copy, modify, register or publish the NST Intellectual Property Assets without NST’s prior written approval. The Customer acknowledges that, where the Customer uses, edits, publishes, imitates, translates, creates derivative works from, distributes, or in any form uses, reuses, copies or modifies anything relating to the NST Intellectual Property Assets (whether in part or in whole), all such products shall be owned by NST.
7.2. The Customer undertakes that it will object to, cancel, not infringe, and/or cause any third party to infringe, object to or cancel any intellectual property right of NST. Except with the written consent of NST, the Customer shall not register, or cause any third party to register, ownership rights to inventions, industrial designs, trademarks, trade names or any intellectual property rights relating to the NST Intellectual Property Assets.
7.3. Where the Customer infringes intellectual property rights as provided in these Terms, the Customer shall be liable to pay a penalty for the breach and to compensate NST for all damage.
7.4. The Customer undertakes not to use the name of other NST Intellectual Property Assets to carry out any commercial or legal activities that harm the rights, interests or reputation of NST. NST shall not be liable for any damage arising from the infringement of intellectual property rights of the Customer.
7.5. These Terms shall remain valid and continue in effect after the Customer ceases to use the Products.
8. THIRD-PARTY SERVICES
The NST Platform may allow the Customer to link or connect to websites, applications or services not controlled by NST (collectively, “Third-Party Services”). When the Customer chooses to link or connect to Third-Party Services, the Customer thereby agrees and confirms that such linking or connection may require access to and sharing of customer information with the Third-Party Services. All Third-Party Services shall be subject to the terms and conditions of the respective third-party providers, and NST shall have no responsibility or liability for any matters relating to the Customer’s activities and transactions with such third parties, or for any content, websites, applications, services, advertisements, links, policies and/or security measures of such third parties that may be accessed, linked or connected through the NST Platform. The Customer is responsible for reviewing all legal regulations and terms (including privacy policies and terms of service/use) of the Third-Party Services before linking, connecting to, downloading, participating in or using such Third-Party Services, and the Customer shall bear full and sole legal liability for all matters relating to the Customer’s activities and transactions with such third parties, as well as for any content, websites, applications, services, advertisements, links, policies and/or security measures of such third parties that may be accessed, linked or connected through the NST Platform.
9. AMENDMENTS TO THE TERMS
These Terms of Use may be amended, supplemented or updated from time to time at NST’s discretion by posting the updated version on the NST Platform and notifying the Customer. The Customer’s continued access to or use of the Products, or the absence of an express written request to NST to cease using the Products, shall be deemed to constitute the Customer’s acceptance of all amendments, supplements and updates to these Terms of Use as of the time the Terms of Use are amended, supplemented or updated.
10. EFFECTIVENESS
10.1. These Terms are binding on the Customer from the time the Customer accesses the NST Platform, provides information to NST and/or uses the Products.
10.2. These Terms shall be interpreted in accordance with and governed by the laws of Vietnam. Where one or more provisions of these Terms conflict with the provisions of law and are declared invalid by a competent court of Vietnam in accordance with the laws of Vietnam, the provision so declared invalid shall be amended to conform to the laws of Vietnam, and the remaining provisions of these Terms shall remain in effect.
